Press Council reprimands Weltwoche: picture of a Muslim woman misused for criticism of Islam
The Press Council upheld a complaint filed by a Muslim woman against *Die Weltwoche*. In its issue 19/2010, *Die Weltwoche* had published an article critical of Islam that included a partial quote from the Quran with the headline: «Kill them wherever you find them.».
The author concluded in his article that "the Muslim faith is not compatible with the rule of law and democracy" and "consequently" should be banned. The main picture accompanying the article showed some Muslims demonstrating on the Bundesplatz in Bern. One of those pictured, whose faces were clearly recognizable, filed a complaint with the Press Council: The picture had been taken several years earlier at a peaceful demonstration against the Danish Mohammed cartoons and appeared here out of context.
In its statement, the Press Council acknowledged the right of the media to express fundamental criticism of Islam and all other religions. However, a medium may not illustrate such an opinion piece with any archive pictures from a completely different context. The main picture of Weltwoche was not a symbolic picture; moreover, the people depicted had not given their consent for a renewed publication in this completely different context. A person who demonstrates peacefully for his religion does not have to accept that his picture later serves as an illustration of an article that denounces this religion and thus also the person depicted as potentially violent and anti-constitutional. "The negative statements of an article inevitably fall back on the persons depicted in it," the Press Council said. And no one would have to be liable as a scapegoat with his face for accusations that have nothing to do with his person, nor with the situation in which the picture was taken. Weltwoche had also violated the privacy of the complainant with the publication of the picture.
