Napalon leather sofa is not a leather sofa

At its meeting at the beginning of July, the Third Chamber of the Swiss Fairness Commission (SLK) had to deal with various complaints that had misleading information as their origin. The recommendations of the SLK were all the clearer.

If a travel agency offers air travel on its website, it is obliged under Articles 13 (1), 11c (2) and 3 (1) of the Price Disclosure Ordinance (PBV) to indicate the actual price including charges. At the same time, the travel provider must indicate how the price is composed (Art. 14 para. 1 PBV). In the present case, however, the travel agency only listed the pure flight costs under "Tariff"; the actual price to be paid was only visible further down the page - without a detailed breakdown of the fees. The travel agency thus violated the PBV once again. In order to prevent a punishment by the responsible authorities, the SLK recommended the travel agency to provide clear information.

Coincidence that the complaint was rejected?

Is it unfair to offer a promotion in which the first 500 customers to sign a contract receive a USB stick? The Third Chamber of the Fairness Commission said no. The telecom company's documents credibly showed that the new customers already knew whether they were among these 500 or not when they signed the contract. If chance had decided, this promotion would be considered a lottery or competition and would be unfair according to principle no. 3.9 of the SLK or according to the Lottery Act. The complaint was rejected.

10 percent discount - or is it?

According to Art. 3 para. 1 lit. b of the Unfair Competition Act (UCA), anyone who makes misleading statements about their own prices or refers to discounts in a misleading manner is acting unfairly (Art. 18 lit. b). References to price reductions such as "10 percent discount" without further details are therefore unfair if they do not relate to the entire product range. In this case, the discount indication must be clearly specified according to the PBV, so that it is clear to the average consumer at first glance to which products the price reduction applies. In principle, this information must appear directly next to the reduction indication, because the PBV clearly requires: "It must be clear from the price announcement to which goods the price applies".

Do you know what Napalon leather is?

According to Wikipedia, "Napalon leather (...) is a high-quality artificial leather. The name is based on nappa leather. Visually and haptically, it comes close to the quality of real leather." But just: Napalon leather is not leather, but a synthetic material. Therefore, the term "leather sofa" for a sofa made of Napalon leather is misleading. The term "leather" arouses the expectation in the average addressee that it is real leather. In the present case, there was also no clarity with regard to the price indication. Thus, the "trinity of image, text and price" was not fulfilled. The SLK approved the complaint.

Hard or soft?

Are caramel candies allowed to be advertised with the claim "Hard or soft?" And only by a well-built young man with an unclothed upper body in a barn with a baby calf nibbling on his jeans. Does this man serve as a mere eye-catcher (there is also a version with a cow and a young woman in a dirndl)? Is this depiction gender discriminatory or even zoophilic, as interpreted by the complainant? The Third Board said no, and dismissed the appeal - even if it did not quite understand why the man had to bare his upper body.

SI shows the hundred most important Bernese women

Schweizer Illustrierte is taking a stand—for women. The magazine asked: Who are the 100 women making a difference in Bern? A jury has made its decision. The results can be found in the current issue. Other regions are set to follow.

According to a press release, the 21st century is the century of women - time for Schweizer Illustrierte to set an example for committed and successful women. A jury chaired by Dori Schaer, a former member of the Bernese government, has selected 100 Bernese women who are making a name for themselves in the city and canton of Bern and far beyond. Ten women were considered in each of ten categories. Stefan Regez, Editor-in-Chief of Schweizer Illustrierte: "Women are doing great things in business, politics and culture, in sports and on the show stage. With this issue, SI wants to set an example for committed and successful women."

Last but not least: Mr. Waiter, please donate

Another efficient fundraising campaign: in Poland, restaurant visitors donate money for starving children by positioning their cutlery when clearing up.

Most people are actually happy to donate. As long as they are not harassed at the front door, inundated with begging letters or intercepted on the street by rebellious students. It is even easier to donate if the amount does not seriously hurt even the smallest budget. Your conscience will thank you. Charitable organizations can count themselves lucky if they can draw on the creativity of creative agencies to generate donations. In spring, for example, credit cards were used to cut off handcuffs and bread in order to trigger a donation of two euros (Last but not least, 29.04.2014). Who can say no to that?

The Warsaw agency Cheil has now also been able to achieve a great deal for the Polish Red Cross with a simple idea. After their meal, restaurant visitors could indicate with their cutlery position whether they wanted to add one and a half euros - a meal for a Polish child in need - to their bill.

Placemats provided information about the campaign, giving guests enough time to think about making a donation at a later date. The media response to the campaign was huge, more and more restaurants joined in and the donations poured in. The fundraising campaign was such a success that the Red Cross is now considering launching it in other countries too. So start thinking about how you're going to put your cutlery down after your meal. (hae)

Wirz and Joiz sink car

Real or fake? An ambient campaign by Wirz draws attention to Mobiliar’s Joiz quiz show «Wer’s glaubt.».

Commuters at the Hardbrücke train station were amazed when they saw a minivan sunk into what appeared to be a freshly paved parking lot on Thursday morning. They learned at the end of the day on the program "Noiz" on Joiz that it was an advertisement for a quiz show.

To draw attention to the second season of "Wer's glaubt", the quiz show about the most unbelievable damage cases, Wirz, Mobiliar and Joiz decided on an attention-grabbing ambient campaign. In cooperation with Streuplan, a minivan sawed off at an angle was placed in such a way that it deceptively looked like a truly spectacular claim. It is still unclear what will happen to the minivan. According to the many positive reactions and harbor crane analogies that followed the breakup, it will probably be auctioned off, he said.

"Wer's glaubt" is a 60-minute interactive live show that is all about crazy claims. Last year, the branded entertainment format was not only very popular with the target group, but was also honored in the industry. Among other things, it won the Goldbach Crossmedia Award in gold. The second season of the show starts on September 18, 2014 (Werbewoche.ch reported).

Trollhauser: Naming for Luzerner Altersheim AG

Trollhauser and Rosenstar came up with a name for the Lucerne Retirement Home Corporation, which was approved by voters and will be established at the end of October. The result: Viva Luzern.

When the voters of the city of Lucerne approved the conversion of the Municipal Homes for the Elderly and Nursing Homes into a non-profit public limited company on May 18, 2014, it did not yet have a name. Time was then of the essence, as the AG would be notarized at the end of October. So the Lucerne-based text agency Trollhauser was commissioned to give the company a name.

After the referendum, Rosenstar, the agency for values and design in Lucerne, was commissioned to create a corporate design for the non-profit AG. On the basis of a values workshop, a brand essence was defined, on which the visual appearance and the name of the AG are based. This is where the text agency Trollhauser came into play. In close cooperation with Rosenstar, research was conducted, ideas collected, and evaluated. In the end, the two best variants were presented. Both met with a positive response, one was chosen, and two weeks later the city council confirmed the favorite: Viva Luzern.

Why was Viva Luzern chosen? Chairman of the Board Beat Däppeler: "The name is easy to understand, catchy and life-affirming. (Quote Neue Luzerner Zeitung, September 5, 2014) And Selina Krummenacher, co-owner of Rosenstar: "On the one hand, this fulfills the requirements from the brand essence of the company. On the other hand, however, the requirements for the name of an organization that serves the general public and is and remains 100 percent owned by the city of Lucerne."
