France Soir: France's first newspaper online only

France Soir will be the first newspaper in the country to publish exclusively in digital format. The long-established French newspaper, which has been operating at a loss, is discontinuing its print edition.

With the discontinuation of the print edition, 89 of the 120 jobs at France Soir, which is under creditor protection, are to be cut. According to SDA, the publishing house management informed the works council at the newspaper's headquarters in Paris on Friday. In protest, the employees refused to produce the Saturday edition. Despite the relaunch, the paper currently sells fewer than 70,000 copies.

During the vacation month of August, the business newspaper La Tribune also discontinued its print edition and only appeared online. However, this was only on a trial basis for two weeks.

JWT/Fabrikant with new mission for Groupe Mutuel

JWT/Fabrikant is now responsible for Groupe Mutuel, one of the largest health insurance companies in Switzerland. The new positioning and strategy for Groupe Mutuel was developed and elaborated in a multi-stage evaluation and analysis, which can now be seen implemented in initial work on posters, advertisements and TV billboards.

"The best, individually tailored protection for all situations - without being overinsured and paying too much": JWT/Fabrikant's strategy is based on this and places the communicative approach "Mission All-round Protection" at the center of all Groupe Mutuel communication measures. This strategy was implemented in the same way. The agency writes in a press release that the communication demonstrates that Groupe Mutuel's focus is on the all-round protection of its policyholders. In other words, the products themselves represent the company's image.

To symbolize the constant protection of the insurance in all situations, a modern, glass guardian angel was developed to accompany the insured as a bodyguard. The agency was able to engage the renowned Zurich photographers Scheffold/Vizner to implement this in a print and poster campaign as well as a sponsoring billboard for the SanaTel product, the round-the-clock medical advice service.

Responsible at Groupe Mutuel: Olivier Revaz (Head of Marketing), Serge Grand (Head of Advertising). Responsible at JWT/Fabrikant: Remy Fabrikant (overall responsibility), Andreas Mädler (Creative Direction), Isabelle Bischoff (Art Direction), David Keller (Text), Christoph Bögli, Katrin Heinrichs (Consulting), Rainer Bühler (Strategy), David Gunten (DTP), Lamar Hawkins (Agency Producer).

Lauterkeitskommission rejects complaint against Radio Basel

On Friday, the Fair Trading Commission dismissed a complaint against Radio Basel regarding its publication of listener figures in the spring of 2011. The complainant, Matthias Hagemann, chairman of the board of Radio Basilisk, had filed the complaint on the grounds that the figures were misleading to the advertising market.

Radio Basel had claimed via print advertising and on the Internet that it had over 100,000 listeners in February/March, who were said to have listened to the station on average every day. The principles of the Fairness Commission had not been violated. In addition, the information was sufficiently, clearly and truthfully declared, according to Radio Basel. After the station had submitted the RAdiocontrol listener data for the two months, the First Chamber of the Fairness Commission decided to reject the complaint.

According to the Commission, anyone who makes incorrect or misleading statements about their goods and services is acting unfairly. The information provided by Radio Basel on the number of listeners was factually correct. Whether the survey methods are representative and the defined intervals are appropriate must be regulated within the industry. This does not yet constitute unfairness or misleading information.

The complainant, Mathias Hagemann, regrets this decision. The Fairness Commission had not decided on the matter itself. The Commission's reasoning shows that it is avoiding the actual legal question. The consequence of this is that a radio station can claim that it had 100,000 listeners in March 2011 (on a certain day at some point), even if the truly representative semester figures from Publica Data for the first half of 2011 show just 74,000 listeners. The Fairness Commission therefore did not rule on the actual complaint as to what exactly constitutes a representative survey method.

"Mosque baba": Swiss advertising expert Segert acquitted

Swiss advertising executive Alexander Segert was acquitted Friday by the Graz Regional Criminal Court of the charge of incitement. The charges were related to the online game «Moschee baba.».

The main defendant, Styrian FPÖ leader and provincial councillor Gerhard Kurzmann, was also acquitted at the trial. The online game "Moschee baba" first caused a stir during the Styrian state election campaign in 2010 and then led to a court case. The internet game involved clicking away mosques, minarets and muezzins to collect points. The Styrian FPÖ had developed the game for the 2010 election campaign together with Segert.

The judge at the Graz Regional Criminal Court justified the acquittal by stating that there were different interpretations of the game and that a decision had to be made for the defendants by applying the so-called rule of ambiguity. In the most favorable form, the game could be interpreted in such a way that the average addressee of the game had been made aware of an issue. The judge also identified clear differences to a shooter game. Overall, the threshold of incitement to hatred had not been reached in his eyes.

In contrast to the public prosecutor, who portrayed the game as highly dangerous, the defendants and their lawyers were at pains to portray the game as a harmless game of skill. The public prosecutor has announced an appeal. The verdict is therefore not final.
