No bold neon sign for lawyers
Law firms are prohibited from installing large, illuminated company signage on the facade of their buildings at night. According to the Federal Supreme Court, this would violate the requirement for discreet advertising. It dismissed the appeal filed by a Zug-based law firm.
The law firm is located in a building in the industrial zone of Cham ZG. It intended to display its name on the façade in blue letters 70 centimetres high. The addition "Advokatur & Notariat" was to follow slightly smaller. The entire lettering was to be around nine meters long and illuminated at night. In terms of type and size, the façade lettering would have been similar to that of the other companies housed in the building.
Only restrained advertising permitted
At the prior request of the law firm, the Supervisory Commission for Attorneys in Zug came to the conclusion that the lettering would constitute inadmissible advertising under the Federal Lawyers' Act.
The Federal Supreme Court has now confirmed this view and dismissed the law firm's appeal. In their deliberations on Friday, the judges of the Second Public Law Division first reminded the court that, since the Federal Act came into force, lawyers are generally permitted to advertise, provided that this is objectively correct and meets the public's need for information.According to the court, however, advertising must be restrained, which is no longer the case in the case under review given the size and illumination of the planned signage. The Federal Supreme Court will decide on a case-by-case basis what should be permitted in future apart from a discreet sign next to the entrance door. (SDA)
