Weko approves OF/Thalia merger

Orell Füssli and Thalia can merge their book retail businesses. The Weko has approved the merger.

At the beginning of March, the two announced the merger of the Swiss book retailing business of Orell Füssli Holding and Thalia Holding (Werbewoche.ch reported). The formation of the joint venture has been deemed unobjectionable by the Swiss Competition Authority Weko and can be completed without reservations. OF and Thalia wrote this in a statement on Wednesday.

The assessment of the merger by the competent authorities in Germany and Austria is still open. According to the statement, the parties will press ahead with the preparatory work so that the new company can commence business operations soon. With the joint venture, in which both partners hold a 50 percent stake, Thalia and Orell Füssli are responding to the massive upheaval in the book industry.

The merger of the book retailing activities in Switzerland is a decisive step towards surviving in the book market, according to the press release. In the rapidly growing online business, the forces could be bundled to stand up to the large international providers. Customers of the new company would also benefit from the latest developments in e-readers and e-books and from competitive prices. They will be able to buy their books from regionally based bookstores throughout German-speaking Switzerland or from the online bookshop of the same Swiss provider.

Arte with new online portal

Arte has expanded its online offering. A new interactive platform is to accompany the television programs with additional information.

The Franco-German cultural channel is launching a new interactive platform on topics from its TV program, as Der Standard writes. "Arte Future" is intended to accompany television programs with additional information. Users can also exchange information in forums on the platform. This was announced by the broadcaster in Strasbourg on Monday, according to Der Standard. The background to this is the trend towards the so-called second screen: Viewers use a second screen next to the television - for example a smartphone - to discuss the TV program or search for additional information.

The new Arte platform will be divided into the thematic areas of environment, science, economy and society. According to the press release, the cultural channel is working on the project with the think tank "Club of Rome" and the daily newspapers Taz and Guardian, among others.

70 percent of streaming users surf the web several times a day

Video and audio services are very popular among the Swiss: About 3.5 million people access video and audio content online, and about 600,000 do so daily or almost daily, according to the latest Streaming Report from Net-Metrix.

This shows that users of streaming services generally surf the web very frequently and do so using many devices. The group of streaming users accounts for around 65% of Swiss internet users, or 3.5 million people. This means that around two thirds of online users at least occasionally use streaming services such as web radio or web TV as well as audio and video content on video, news and TV portals. In terms of socio-demographic structures, men continue to be more strongly represented than women (56.7% to 43.3%) and the age group up to 39 years includes the most streaming users (59.9%). Overall, the trend comparison since the first survey in 2011 shows a slow convergence of structures towards the online community.

Streaming users are often on the web

A comparison of the different user groups in terms of the frequency of general internet use shows that users of audio and video content are more likely to be found on the web than the average internet user: 88.3% of streaming users surf the internet daily or almost daily compared to 80.5% of online users. This shows that seven out of ten streaming users even go online several times a day and among streaming heavy users, nine out of ten people surf the web several times a day.

Further differences are also found in the number of devices used to visit the web: At 46.2%, less than half of online users use three or more devices for the internet. Among streaming users, the figure is 54.6% and among streaming-heavy users it is as high as 62.4%. Obviously, the use of video and audio content via the web goes hand in hand with generally frequent internet use, which also takes place across multiple devices.

Video portals most popular

The frequency of use of web content in general and therefore also of various streaming services can also be influenced by socially relevant events. However, a look at the various categories of content since the first survey in 2011 reveals a relatively stable picture: the use of videos on video portals such as YouTube, Clipfish or MyVideo is clearly the most popular. More than one in two online users (53.8%) state that they consume such content several times a month or even more frequently.

In second place on the popularity scale is the category of videos on news or TV portals and clips on websites in general: around four out of ten online users (41%) use such services at least several times a month. The consumption of web radio offerings (34.5%) and web TV content (28.9%) from providers such as Wilmaa, Zattoo or Teleboy are in second place. The share for the audio archive category, such as podcasts, is slightly lower. podcasts (26.8%).

Last but not least: F***ng Shit

A new news anchor in North Dakota demonstrated how it's possible to get fired before you've even had a chance to say your first official words. Unfortunately, his very first words weren't official, and they certainly didn't sound very polite either.

The newsreader put an end to his very short career with the words "F***ing sh*t". At least he is now, along with his video, in the viral "Hall of Fame". Discovered by Viedo The world.

Federal court rules in favor of Observer journalist

The public has a constitutional right to know which judges issued a particular ruling. According to the Federal Supreme Court, a journalist must be informed of the judges who issued a ruling.

The Federal Asylum Appeals Commission, which was merged into the Federal Administrative Court in 2007, had made a landmark decision in 2005: people from Eritrea who deserted before serving in the army are considered refugees because they face severe mistreatment if they return. A reporter for the Observer, in connection with an article on Swiss refugee policy in 2012, asked the Federal Administrative Court to send him the decision and to disclose the judges who would have been involved in it. The court's secretary general sent the ruling but refused to disclose the panel of judges.

Wrongly, as the Federal Court has now ruled on the journalist's appeal. In their decision, the judges in Lausanne refer to Article 30 of the Federal Constitution, which enshrines the principle of judicial publicity.

No secret justice

In concrete terms, this constitutional provision guarantees that a judgment - no matter how important or insignificant - can be taken note of by the public. In principle, this right extends to the entire judgment, including the facts of the case, the reasons, the dispositions and the judges involved.

According to the court, the principle of judicial publicity ensures the transparency of judicial proceedings and means a rejection of any form of secret justice. The principle is of central importance for the rule of law and democracy and also serves to create trust in the judiciary.

Restrictions possible

According to the Federal Supreme Court, if the persons involved in a decision could remain unknown, the control function associated with the principle of publicity would be impaired or even illusory. Moreover, judges would exercise a public office and would also have to face possible criticism.

However, according to the court, restrictions to the principle of publicity are possible if this is necessary to protect personal or public interests. In this respect, it was also permissible in the present case for the name of the complainant concerned to be made anonymous.

As far as the responsible judges were concerned, however, it was not evident why they should no longer stand by their judgment and why they should be protected in their trust in anonymity. (Judgment 1C_390/2012 of March 26, 2013, BGE publication) (SDA)

Advertising on the way to the mailbox

Internet users visit service portals such as Bluewin.ch, Msn.ch, or Gmx.ch primarily to check their email. Once they arrive on the site, many end up browsing the news section. This makes these service sites attractive for online advertising.

"Email is a usage driver that leads to users coming to the portal several times a day. At the same time, more than 95 percent also engage with the content offering," says Nadja Elias, PR Manager at portal marketer United Internet Media. Particularly in campaigns with a short duration, in which a certain dose of contact must be achieved in a short time, the high frequency of visits pays off.

To make Gmx.ch attractive as an advertising platform, United Internet Media invests in technological development and online research. A Responsive Design ensures that the visibility of advertising media is guaranteed across all screen sizes. In addition to key figures such as ad size and ad view time (how long an ad or parts of it are potentially visible on the display), the context in which the ad is embedded is also taken into account - i.e. with which content the ad vies for the user's attention (ad clutter).

Above all, however, United Internet Media is concerned about how advertising affects the user. "Online advertising should not be annoying. If an advertising medium causes a reaction, this has a negative impact on brand sympathy," explains Michael Burst, Head of Market and Media Research at United Internet Media. In the freemail sector, Gmx.ch is therefore holding back on advertising. After all, users want to read or compose e-mails there. Burst, on the other hand, considers the log-out area to be particularly attractive. "After logging out, users are in a transition phase and are relatively open to advertising." On the log-out page, Gmx.ch therefore offers advertisers the opportunity to place a prominent, large-format advertisement exclusively.

Depending on the type, size and placement of the advertising medium, the actual contact dose achieved by a campaign is evaluated. "In our experience, an average of six to seven contacts is most effective for branding campaigns," says Burst. In the case of larger campaigns, Burst and his team use surveys to collect not only purely technical indicators such as ad size, ad visibility and ad clutter, but also qualitative factors of the advertising impact, such as brand awareness, advertising recall, purchase intention and brand sympathy.

Online must prove itself

In Germany, United Internet Media reported record results for the past year. However, the portal marketer has not yet succeeded in making the leap into Switzerland. The opening of a sales office in Zurich, as planned for last summer (Advertising week reported), has been put on hold. The decision was made to wait and see, due to the development of the Swiss online market. With an online share of eight percent in the media mix (Media Focus), Switzerland is one of the worst performers in Europe.

United Internet Media has a lot at stake in convincing Swiss customers of the value of its advertising offering. "Online must and can provide the same proof of performance as TV or print," Elias is convinced. Elias and Burst cite the implementation of cross-marketer studies as a goal, as is common in other media. Industry-wide research would not least benefit the credibility of the medium.

The cooperation for 2013 is regulated in a renewed framework agreement. The two companies wrote this in a statement on Tuesday. The advertising space is being brokered on a non-exclusive basis.

In addition to the switching service, order processing is already carried out to a high degree of automation through interfaces between the technical systems of Tamedia and Publicitas. The two companies are continuing their long-standing partnership with the new contract, which replaces the agreement from 2011.
