Schawinski wins against Lebrument in federal court

The Federal Supreme Court has upheld an appeal filed by Roger Schawinski against Hanspeter Lebrument. Schawinski had sued Lebrument for infringement of personal rights and a violation under the Unfair Competition Act (UWG).

The jurisdiction was unclear, according to a statement from Radio 1. The Zurich Commercial Court had previously ruled in favor of Lebrument. Roger Schawinski took the case further and has now won before the Federal Supreme Court. Lebrument must pay the court costs of 5,000 francs and a party compensation of 6,000 francs to Schawinski. This now clears the way for a substantive treatment by both the Commercial Court in the matter of UWG and the District Court in relation to the claim of infringement of personality, the statement continued.
