On the left, the logo of the Rapperswil-based solar tile company; on the right, that of the Zurich-based media group.

The Rapperswil-based company had the name TX Group re-registered with the Commercial Register Office in St. Gallen on December 19, 2019. One day later, the same thing happened at the Commercial Register Office in Zurich. In this case, it was the former Tamedia that had changed its name at the Extraordinary General Meeting. This emerges from the facts of a public party hearing before the Federal Administrative Court on September 19.

The then Tamedia had announced its planned name change in a media release at the end of November. The Zurich and St. Gallen Commercial Register Offices were nevertheless unaware of the virtually simultaneous registration of the TX Group name. Both authorities reported the name to the Federal Office for the Commercial Register in Bern.

Rapperswil TX Group claims name for itself

In mid-March last year, the Rapperswil-based company claimed in Bern that the name TX Group belonged only to it. The Office for the Commercial Register should therefore ensure that the legal status is restored or it should issue a contestable ruling.

According to the facts of the case, the office did not accept the request because it did not consider itself competent. It justified its decision by saying that it could not make any changes to the Zurich Commercial Register. The Rapperswil-based TX Group has therefore appealed to the Federal Administrative Court. Grip für Ylex: Recht einfach umgesetzt https://www.markt-kom.com/en/kreativity/kampagnen/grip-fuer-ylex-recht-einfach-umgesetzt/ Mon, 29 Aug 2022 07:46:08 +0000 https://www.markt-kom.com/?p=185089 YlexLife is complicated. Who doesn't know the situation where you would like to get legal advice, but you shy away from the effort? Ylex, with its simple legal access at clearly defined price packages, offers a solution for all these people, democratizing the legal system by giving everyone access to justice. Legal advice is available online, by phone or in person during a visit to one of the current four walk-in stores in Bern, Winterthur, St. Gallen and Zurich.

To raise awareness of Ylex and its services, Grip has developed a campaign that focuses on the most common conflict issues. The first campaign spots tackle three emotional topics related to employment, landlord-tenant and divorce law. The spots go into the middle of each person's emotional outburst and nonverbally express their outrage over their incident. Their thoughts are faded in textually and brought to the point in the most succinct form.

The spots will be flanked by a typography campaign that will be distributed via social ads, YouTube pre-rolls or displays. "Each message is limited to one word. A single word that, through its dramaturgical animation, translates the legal tension it serves not only textually but also scenically," explains Daniel Schranz, CD at Grip.

Responsible for Ylex: Ioannis Martinis (Head of Communication & Marketing Ylex AG), Daniel Siegrist (Board of Directors Ylex AG). Responsible for Grip: Daniel Schranz (CD), Sandro Nicotera, Florian Steiner (concept/art direction), Claudio Lier, Malou Eigenmann (consulting), Beat Reck (text), Simone Nucci (typo-animation). Politwerbung in Radio und TV: Gericht heisst Beschwerde von CH Media gut https://www.markt-kom.com/en/markom/politwerbung-in-radio-und-tv-gericht-heisst-beschwerde-von-ch-media-gut/ Fri, 26 Aug 2022 14:11:20 +0000 https://www.markt-kom.com/?p=185013

CH Media said on August 26, 2022 that it was pleased with the ruling but fundamentally questioned why political advertising is banned on radio and TV while it is allowed in all other media.

From August 11 to 18, 2020, the CH Media TV stations Tele Züri, 3+, 4+ and 5+ aired several times a commercial on behalf of an ostensibly non-profit organization, which showed a girl running through green meadows, through a town and along a lake in a mountain landscape. The girl praised the beauty of nature and asked the viewers to protect the landscape. On the final statue was the writing "For the protection of the landscape and culture of Switzerland".

From August 18, 2020, a film was published on the Internet, the first part of which contained largely the same images as the TV commercial and the second part of which was supplemented with new images and statements. At the end of the online film, a recommendation was made for the referendum of September 17, 2020 "For moderate immigration (limitation initiative)". The Federal Office of Communications, or OFCOM, subsequently investigated this TV commercial and found a violation of the ban on political advertising on TV before referenda. CH Media appealed against the decision to the Federal Administrative Court. Because of the online film, which was shown on social media and elsewhere, OFCOM did not even take action - since political advertising is permitted in media other than radio and TV.

Court finds no violation

In its ruling, the Federal Administrative Court states that the online film, which was published on the Internet on August 18 after the TV commercial was broadcast, is not subject to the ban on political advertising before votes under the Federal Law on Radio and TV (RTVA). In addition, the TV spot had no recognizable connection to the limitation initiative or a related topic, which meant that it could not be recognized as prohibited political advertising at the time of the TV broadcast. Finally, according to the court, it was not possible for the broadcaster to determine that the TV spot was part of a cross-media voting campaign prior to publication of the online film. CH Media is pleased with the ruling and sees itself confirmed that it did not violate applicable law in the case in question.

Regulation concerning political advertising is to be questioned

The current ruling is a reason for CH Media to initiate a discussion about which media allow political advertising and which do not. "Political advertising is banned on TV and radio, but allowed in other media. This is strange and incomprehensible, especially since Internet platforms such as social networks or search engines hardly know any rules in the area of political advertising," says Anne Peigné de Beaucé, Head of Public Affairs at CH Media and Managing Director of the Swiss Private Television Association, or VSPF for short.

Cybersicherheit: Vernetzte Geräte müssen Privatsphäre besser schützen https://www.markt-kom.com/en/digital/cybersicherheit-vernetzte-geraete-muessen-privatsphaere-besser-schuetzen/ Thu, 25 Aug 2022 15:44:33 +0000 https://www.markt-kom.com/?p=184962

Better protection of users' privacy and personal data is to be achieved with a revision of the Ordinance on Telecommunications Installations (VFAV), as the Federal Office of Communications (OFCOM) announced on Thursday. In addition, the risk of money fraud is to be prevented and the resilience of the communication networks strengthened.

The revision will come into force on September 1, 2022. Every wireless device and product that can be connected to the Internet for communication must then have functions that guarantee the protection of personal data, especially when children are involved, Bakom writes. Manufacturers and developers will have to apply Bakom's new regulations from August 2024.

Reduce risk

If a smartphone or other wireless device can be used for electronic payments, he said, it must have features that significantly reduce the risk of fraud - for example, stronger user authentication controls.

In addition, it must be ruled out that networked devices can interfere with communication networks or disrupt the operation of websites or other services. They must therefore have functions that exclude such risks, according to Bakom.

The new regulations will align Swiss legislation with that of the European Union. According to Bakom, the EU standardization bodies are currently drawing up harmonized standards that should be available to European and Swiss industry by the end of September 2023 at the latest. (sda.)

Axa-Arag lanciert Podcast zum Thema Recht https://www.markt-kom.com/en/markom/axa-arag-lanciert-podcast-zum-thema-recht/ Mon, 04 Apr 2022 10:42:33 +0000 https://www.markt-kom.com/?p=168666 Axa-Arag lanciert Podcast zum Thema RechtTaking up everyday topics and illuminating their legal aspects - this is the focus of the new podcast "Recht aktuell," launched by Axa-Arag Rechtsschutzversicherung. The first season of three episodes focuses on various forms of cohabitation: listeners are immersed in the problems of a shared apartment, a cohabiting couple with a child, and a same-sex couple looking to get married. Advantages and disadvantages, hurdles, disadvantages and current developments in the law are highlighted.

Discuss legal issues

Who decides on life-sustaining measures: the parents or the cohabiting partner of an injured person? Do parents who are not married automatically have joint custody of their child? And what will happen to registered partnerships when marriage for all is introduced in July 2022? The protagonists in the podcast discuss various legal questions, which are then classified and answered by a lawyer from AXA-ARAG. The mixture of moderated expert talk and conversations from those directly affected makes the podcast lively.

Personal access to the law

"We offer listeners relevant insights and make legal topics tangible," says Antonia Lepore, Head of Marketing Communication at AXA. The podcast format is particularly suited to this because complex topics can be explained simply on the soundtrack. "Podcasts are very attractive and popular. We want to use that to build proximity and trust as well as personal access to the law." The podcast deliberately does not mention any AXA-ARAG products, but merely draws on the expertise of the legal expenses insurance company.

The production of "Recht aktuell - der Rechtspodcast mitten aus dem Leben" was realized together with the Podcast-Schmiede in Winterthur. The three episodes in Swiss German, each lasting 15-20 minutes, can be found on all popular podcast portals.
